Tips for Filing Your Case
As a general rule, try to follow the following advice once you have retained our office. This will help ensure a smooth bankruptcy process. These are only general suggestions and are not case specific.
- One Year Prior
- Do not pay off any family, friends or relatives as the court can recover whatever you pay to them within one year prior to filing under preference transfers.
- If you have a bankruptcy case dismissed within the prior year, then we need to do certain things to ensure you can keep your bankruptcy protection.
- If you tried to delay or defraud your creditors by transferring assets two to four years prior to filing your bankruptcy, the Court may deny you a Chapter 7 discharge and recover the transferred property. Do not transfer anything until you speak to our attorneys. If you have already made transfers of assets within the prior few years, please ensure that you reveal said transfers to our attorneys so that they may fully discuss all of your options.
- 6 Months Prior
- If a previous case was dismissed because your requested dismissal or did not follow court order you may have to wait 6 months to file another case.
- 3 Months Prior
- You must complete a Budget and Credit Counseling Course. Do not worry, these only take about a half hour and cost $30 -$40 and can be done on the internet or telephone. This class issues a certificate that is only valid for 180 days.
- The Court can recover any major payments made to creditors within 3 months of filing except for house or car payments.
- You must reside in Colorado for 3 months and a day prior to filing your bankruptcy.
- Do not purchase any luxury goods within this period of filing your case.
